INTRODUCTION

French colonial and territorial records of the District of Ste. Genevieve comprise this collection which includes Ste. Genevieve County and Court records. One third of the documents are dated 1756-1804; the remainder date from 1805 to 1930.

DONOR INFORMATION

The collection was loaned to the State Historical Society of Missouri for microfilming on 21 September 1978 (Accession No. 2195). The original documents are in the possession of the Ste. Genevieve County Court.

SCOPE AND CONTENT NOTE

The Ste. Genevieve, Missouri Archives contain account books, affidavits, agreements and contracts, bonds, notes, and obligations, correspondence, deeds and indentures, land concessions and transactions, estate papers, wills, marriage certificates, contracts, genealogical materials, miscellaneous commercial papers, materials pertaining to African slaves and Native Americans, inquests, litigation, territorial administrative records, district and court records, and court and county records.

The collection provides a comprehensive overview of French territorial society, both administrative and social. Documents exist in French, Spanish, English, and to a lesser extent, German. The collection is arranged in seven series:

An itemized inventory provided by the Ste. Genevieve County Court accompanies the microfilm (introductory rolls one and two). Penciled notations and numbers found on the docketed side of some documents were placed there prior to microfilming.

FOLDER LIST

Accounts Series

The Accounts series, dating from 1764-1867, contains account books and miscellaneous accounts. The series includes account books, daybooks, ledgers, itemized accounts and receipts, bills of sale, lists of debts, itemized lists of supplies, medical bills, quittances, petitions, and due bills for completed work. Although the majority of the series documents are in English, there are materials in French and German.

The books are arranged by type and then chronologically and date from 1796 to 1867. Although the majority of the material is in English, folders 2, 4, 6, and 8 contain accounts kept in French. Folders 7 and 15 contain account books in German. The miscellaneous accounts contain the earliest dated material, from 1764 to 1801. Documents include itemized accounts for medicine for a mulatto slave owned by Ann Dodge, expenses for travel, itemized bills for medical care, whiskey, carpentry and smith work, lead, and bills for furs and staples. Other accounts include a list of debts owed to Denton and Company, a receipt for a coffin, itemized list of supplies and expenses for voyages, and a 1799 receipt from the Randolph County recorder for documents found in the house of a soldier in Kaskaskia. The series also includes quittances signed by commandants (notably Francois and Jean Baptiste Valle, and Silvio de Cartabona) of the posts of Ste. Genevieve and New Bourbon.

Legal Documents Series

The Legal Documents series is arranged by type, dates from 1757 to 1895, and contains some documents written in French and Spanish. The series is further arranged into seven subseries:

Agreements and Contracts Subseries

Documents of agreement, contracts, and engágés comprise the Agreements and Contracts subseries. The material dates from 1767 to 1853 and is filed alphabetically; with the exception of the engages, which are filed together. Also included are division of community property papers, promissory notes, arbitration documents, and agreements to teach in New Bourbon, deliver salt, and to rent or lease furnaces, oxen, houses, land, and slaves. This subseries also contains bonds, notes, due bills, obligations, and related correspondence which are filed alphabetically by signer. The majority of the documents, dating from 1766-1802, are written in French. Related documents dated 1805 and later are filed chronologically with the Court and County Records series.

Deeds and Indentures Subseries

The subseries dates from 1766 to 1869 and is arranged alphabetically by surname. The subseries contains primarily deed documents including acts and contracts of sale, acts of donation, deeds of gift, cession and exchange, auction, and abandonment records. Payment was rendered in merchandise, wheat, flour, lead, silver, furs, and piasters. A few bills of sale, sale notices, promissory notes and petitions are filed with the deed to which they relate. Plats and plans of surveys, recorder's receipts, and fee statements are attached to some deeds. Deeds and indentures for land, buildings, animals, personal items, mills, and slaves are included. Sheriff’s sales are filed under “Sheriff” and then alphabetically by owner; sales by the state are filed under “State.” Miscellaneous deeds and indentures (f. 77-85) include bills of sale for slaves, marriage contracts and estate administration papers, lists of land owners and property locations, land sale notices, descriptions of title rights and claims, petitions and orders for land partition, and requests to the circuit court clerk for deed and title information.

Land Concessions Subseries

The subseries is arranged alphabetically by surname and dates from 1770 to 1805. Documents include orders of survey, recorder’s opinions, concessions (alphabetical by surname of individual to whom concession was made), affidavits and testimonies concerning claims, petition for land, receipts, and related correspondence, and an itemized list of St. Aubin lots. Folders 94-96 contain receipts and petitions relating to land concessions. They are filed alphabetically and also include acts of partition and related correspondence.

Land Transactions Subseries

Documents recording changes in land ownership from 1766 to 1870 comprise the subseries which is arranged alphabetically by topic and then by surname. Documents of exchange for lands, slaves and other property are filed alphabetically (f. 97-98). Lease documents are filed alphabetically by leasor (f. 99). The subseries also contains mortgages, public sales documents including sales notices, itemized sales inventories of real and personal property and slaves, property appraisals, surveys and plans, and miscellaneous related papers.

Estate Papers Subseries

The estate papers, the largest section of the Legal Documents series, dates from 1757 to 1895 and is arranged alphabetically by surname of the deceased. Many of the materials are written in French or Spanish. French and Spanish documents (1757-1804) and court records of estate administrations (1808-1895) are filed together alphabetically by the name of the deceased. The estate appraisal of John Birk, listing slaves, furniture, livestock, books and papers, carpenter and blacksmith tools illuminates the depth of material within the papers. Additional materials include receipts for taxes, wills and codicils; the instructions for the care, disposition of, or emancipation of slaves; statements of estate settlement, names and relationships of heirs, powers of attorney, baptism papers, and petitions. Wills (1766-1839), are filed alphabetically.

Litigation Subseries

Litigation proceedings, filed alphabetically by surname of the plaintiff, comprise the Litigation subseries. The documents date from 1766 to 1804 and include affidavits, testimonies, depositions, petitions, correspondence, official communications, summonses, arbitrations, judgments, decrees and orders, and related papers. Cases were filed over assault charges, bad debts and bankruptcy (f. 347-348), community property (f. 350), inciting Indians (f. 317), trade with various Indian tribes (f. 337), church pew rentals (f. 331), the value of slaves and their mixed blood descendants (f. 349), and reneging on contracts or engágés. Examples of commercial transaction cases include the suit Silvi Francois Cartabona filed in 1776 against Benito Basquez over a boat (f. 311) and in 1800, John Coffee sued Mrs. Peyroux over salt (f. 314). William Cowan sued James Ferrell in 1799 regarding salt and the sale of pigs and then in 1802, filed suit against Benjamin Spencer and P. Lafleur for debts owed (f. 316).

Women sought relief in the courts as well. In 1798, Elizabeth D'Atcherutte, a free woman of color, filed suit against the heirs of Antoine Aubuchon claiming Aubuchon to be the father of her ten children (f. 317). Marie Louis Despins sued husband Charles Charleville for money and the inheritance of her father (f. 319). In 1770, Genevieve Hunaud Courtois sued her husband Louis Courtois, for a legal separation due to physical abuse (f. 332).

The final folder in the subseries contains miscellaneous papers which could not be interfiled with other litigation materials. The documents, filed in chronological order, include testimony, court orders, affidavits and petitions. Marriage Certificates and Contracts Subseries

This subseries, arranged alphabetically, contains marriage certificates and marriage contracts, divorce papers including separation agreements, petitions and decrees (f. 360, 364, and 373), and elopement proceedings (f. 357). Materials date from 1756 to 1860. Of special interest is the 1826 marriage certificate for Lewis Morose and Elizabeth N., a free woman of color (f. 367); the 1769 marriage contract between Charles Valle and Pelagie Carpentier and the couple’s divorce proceedings of 1783 (f. 373). Folder 374 contains lists of marriages filed for record. Marriages were solemnized by Isidore Moore, Father Xavier Dahmen, Thomas Horn, John Brands, R.B. Griffith, and William H. Pinkston. Note that there are also marriage records from 1853 to 1859 in folder 1432.

Miscellaneous Papers Series

The Miscellaneous Papers series is arranged by topic and dates from 1766 to 1846. A majority of the documents are dated after 1805 and are written in French. This series focuses primarily on the lead and iron mine industry, slaves and the commerce surrounding the practice, and miscellaneous personal commercial transactions. There are three subseries:

The first five folders include miscellaneous materials pertaining to boats including affidavits, ferry & boat licenses, petitions, barge inventories, passports, arbitrations, and testimony regarding wrecks; materials pertaining to the Creek, Muskoe, Osage, Shawnee, and Peoria Native American tribes (alphabetically by tribe or author of document when tribe is unknown); inquest documents (alphabetical); and correspondence (filed alphabetically by author) with a few English translations accompanying the French letters.

Mines Subseries

This subseries is arranged alphabetically by mine name and then by type of mine. Documents include appointments of officials to office, litigation proceedings for collection of debts, orders to pay wages and seize property, petitions for land concessions and protests regarding same, notices of mineral sales and the resulting bills, correspondence, accounts and itemized lists, affidavits, claim transfers, engágés and bills of replevins, property sale notices, lease agreements, dissolution of partnership, bonds, itemized creditors’ lists, and merchandise delivery receipts. Of particular interest are the petitions by entire communities against individuals: the inhabitants of Mine a Breton versus Pierre Vial dit Manitou (f. 381); the petition of Ste. Genevieve citizens to prevent Boyce from interfering with their access to the salt spring (f. 386); and the petition of the inhabitants of Old Mines against Amable Mason (Partenais) for polluting their drinking water, the response by Partenais, and the notations of Amos Stoddard on both documents (f. 390). Personal Property Subseries

This subseries is arranged alphabetically and includes bills of sale for personal property (f. 392, 394, 395), gifts of slaves, animals, and other personal property (f. 400), sale notices and accounts, inventories of furs and personal estates (f. 394, 395, 397), petitions regarding community rights (f. 395), delivery of lead, firing of guns (f. 391), and the killing of a bull (f. 393), sale and transfer of part interest in a steamboat (f. 391, 395), proceedings of creditors against debtors, character references (f. 399), and the sale of weapons taken from the bodies of five men killed on the St. Francois River in 1781 (f. 391). In two cases of malicious slander, Amable Partenais dit Macon signed an affidavit in 1800 denying calumny against Catherine Gagnon (f. 398); and in 1773, Pierre Verau retracted his charge of calumny against Marianne Courtois (f. 399). Folder 401 includes eight affidavits to procure benefits for Revolutionary War soldiers, from an Act of Congress passed 7 June 1832. Enlistment dates, description of service, discharge dates, and date and place of birth are given. Also included are supporting testimonies and printed rules issued by the War Department Pension Office on 18 September 1833, with handwritten notations concerning pension requests. Folder 402 contains materials pertaining to roads including land owner testimonies regarding the incursion of roads and fences; petitions to prevent the closing of public roads; nomination of arbitrators in Ste. Genevieve to act on bridges, roads, streets, and fences; grants of rights of way and a plat of a territorial road survey from Big Shawanoe to Ste. Genevieve. See also the Court and County Records series for related materials dating from 1807 to 1873. The Paul de St. Pierre Papers comprise folder 403. Documents include the 1790 sale of a slave, receipt of a deer skin, and an order by Francois Valle to dismiss an Englishwoman claimed to be a witch and living with Louis Coyteaux with supporting materials provided by St. Pierre regarding the scandal. Also included are correspondence between St. Pierre, Francois Valle, and Baron de Carondelet and a 1798 inventory sale of personal property of St. Pierre.

Slaves Subseries

Materials within this subseries date from 1766 to 1846 and are arranged alphabetically by slave owner under each subject heading. Litigation over theft of slaves, selling liquor to African and Indian slaves, mortgages, and the use of slaves include affidavits, depositions, testimony, correspondence, petitions, sureties, summonses, arbitrations, court orders and judgments, and related materials (f. 422-424). Folder 425 contains slave mortgages dating from 1797 and 1798. Miscellaneous slave ordinances dating from 1770 to 1796 comprise folder 426. Included are an order for a slave to be turned over to another individual; ordinances stating that masters must keep their slaves at home; slaves must not be given passage across the river without showing their passports; slaves must be in their cabins at the firing of a cannon at night; and that slave owners be taxed to defray expenses of executing slaves in New Orleans found guilty of sedition. Ste. Genevieve Official Papers Series

Official documents dating from 1766 to 1885 comprise the Ste. Genevieve Official Papers series, the majority of which are arranged alphabetically. The series includes appointments, commissions of justices of common pleas and justices of the peace, bonds written to the governor by constables, and oaths of office and in support of the constitution (f. 428). Folder 429 contains petitions, regulations, and agreements of Ste. Genevieve citizens concerning fences. Materials pertaining to the construction of the Church of Ste. Genevieve comprise folder 430.

Folder 431 contains a copy of the translated Spanish letter, signed by Manuel de Salcedo, to the Spanish commandants of Upper Louisiana notifying them of the retrocession from Spain to France and instructing them to deliver the territory to the proper French authorities. Notices for public sales of animals and property comprise folder 432. The folder also includes an 1802 public notice signed by Delassus de Luziere and Francois Valle regarding a new treatment against smallpox; and a public notice verified by J.B. Valle and St. Gemme Beauvais of correct weights and measures. Folders 434 and 435 contain ordinances, rules, orders, instructions, permits, appointments, and related items. Ordinances emphasize the proper burying dead animals and the admission of emigrants. Orders focus on passports owing to the war between Spain and Great Britain, mail delivery, and the forbidding of inhabitants from receiving strangers without a permit from the commandant. Also included are instructions to the commandant regarding the treatment of emigrant colonists, concessions, and passports; manifest of the King of Spain on the war declared on England; and rules for construction and upkeep of bridges, streets, and canals.

Miscellaneous petitions comprise folder 436 and include a petition for the removal of the court house from St. Louis to Ste. Genevieve; the inhabitants of Ste. Genevieve petitioning for the construction of a jail; and the petition of the citizens of New Bourbon to have their lands surveyed. Folders 437 to 439 include powers of attorney documents, arranged alphabetically. The majority of the materials relate to estate administrations, collection of account due, litigation, and lands.

The bulk of the series is arranged chronologically and then under the following headings: accounts, notes and receipts, appointments, commissions, oaths of office, and bonds of officials; bills against the district, litigation in the court of common pleas, court of general quarter sessions, and general court, summonses, subpoenas, writs of execution and arrest, statements of charges, fee bills, depositions, testimonies, grand jury indictments, recognizances, warrants, related accounts, notes and receipts; and miscellaneous records. Litigation documents include more than trial related materials. The Court of Quarter Sessions litigation (f. 516) contains a district levy itemizing names, number of town lots, wind and water mills, houses, and valuation. Court of Common Pleas litigation contains promissory notes, itemized accounts for whiskey and other goods, detailed listing of provisions for troops (f. 520-528), agreements to build a flat bottom boat and questions regarding boat construction (f. 548). The Miscellaneous County Records series dates from 1807 to 1892 and contains six subseries:

Each heading is arranged by the following: citizenship documents (alphabetical); census, elections, licenses, military records, strays and tax lists (chronological); and roads and bridges, and schools (chronological, followed by undated).

Folder 1296 contains immigrants’ certificates, the first step to naturalization, for Casper Carl, Simon Grass, Thomas Hogg, William Joggerst, Joseph Jokerst, Francis Joseph Kettinger, Jacob Laiben, Thomas Maxwell, Ambrose Meagher, Joseph Oberle, Michael Stoll, and Anton Vogt. Also included is an 1847 citizenship petition for Jean Baptiste Liavre.
