DONOR INFORMATION

The Atwood Papers were donated to the University of Missouri by Agnes L. Atwood on 21 March 1945 (Accession No. 2220).

BIOGRAPHICAL SKETCH

Frank Ely Atwood was born at Carrollton, Missouri, on 5 October 1878, the eldest of six children. He was raised on a farm. He graduated from William Jewell College. Reading law with the firm of Lozier and Morris in Carrollton, Atwood was admitted to the bar in 1904 and was a partner with Lozier and Morris until 1914 when he became a partner in a firm with his brother, Smith B. Atwood.

In 1915 Carroll County elected him prosecuting attorney after he had served a year as mayor of Carrollton and in 1922 he was a delegate to the state constitutional convention.

He moved to Jefferson City when he became assistant counsel for the state public service commission. He served there two years and ran for the state supreme court in 1924. He was elected and served a ten-year term.

As an attorney and judge he frequently contributed articles to professional publications. After leaving the court he re-entered law practice with his brother Smith in Jefferson City. In 1934 he was elected president of the Missouri Bar Association and in 1938 became president of the American Judicature Society.

Atwood ran for the court again in 1940 but was defeated. He served some time on the program committee of the Republican national party organization. He was one of the principal legal advisors to Forrest C. Donnell during the contested gubernatorial election in 1941.

Atwood was married to Agnes Rae Luscombe. There were no children. He died on 5 March 1943 in Carrollton.

SCOPE AND CONTENT NOTE

The Atwood Papers are arranged into five series:

The Correspondence series is the largest series of the papers, dates from 1901 to 1942, and is arranged chronologically. The correspondence covers the major areas of Atwood’s life: church activities, Republican politics, and legal affairs. In the 1920s Atwood dealt with the Lakes to Gulf Highway Association and missionary work in China, was appointed to the Public Service Commission, and campaigned for judge on the Missouri Supreme Court. The 1930s saw him involved with the Missouri Bar Association and elected its president, elevated to chief justice of the state supreme court, and working on the Republican program committee. In the 1940s Atwood again ran for the supreme court and represented Forrest C. Donnell in the contested gubernatorial election.

The Organizations, Societies, and Committees series consists of material related to Atwood’s personal, legal, and political interests and is divided into six subseries. The William Jewell College subseries dates from 1913 to 1943 and shows Atwood’s continued involvement with the school. The subseries deals with activities of the Phi Gamma Delta fraternity; fund raising; discussions on the long-range growth, development, and functions of a small Christian liberal arts college; and financial affairs.

The American Judicature Society subseries dates from 1931 to 1946 and includes minutes, financial statements, and material pertaining to Atwood as acting president of the society. The Missouri Bar Association subseries consists of correspondence for the years 1924 to 1942 and material related to standing and special committees of the association in the 1930s.

The correspondence in the American Bar Association subseries dates from 1923 through 1943 and deals with committee assignments, the 1937 annual meeting in Kansas City, and Atwood’s appointment as chairman of the Law Lists Committee. The special committees material shows the organization, administration, activities, and reports of several committees. A large portion of this material deals with the Law Lists Committee.

The Federal Bar Examining Committee subseries, dating from 1935 to 1943, documents the activities of a committee to standardize the admission of lawyers to practice law in the federal courts and includes application forms used in various states; examples of an application form to be used in Missouri; minutes of committee meetings; copies of federal bar examinations; applications; questions submitted by committee members; revisions to questions; model answers; analysis of applicants’ answers; a grading system; and statements of expenses.

The Republican Program Committee subseries, dating from 1938 to 1940, includes correspondence and reports. Of note is a copy of the Republican State Platform for Missouri from 1938 in folder 806 and the final draft of the Program Committee report, 1939, in folder 821.

The Legal Papers series consists of opinions from 1925 to 1934 rendered by Atwood during his tenure as Missouri Supreme Court judge. The opinions are arranged chronologically. The series also includes correspondence, legal documents, and notes on cases handled by Atwood as a private attorney. This is one of the larger sections of the Atwood Papers. A listing of the cases is in the appendix following this inventory. The cases are arranged in roughly chronological order.

The Miscellaneous series contains speeches on religion, politics, and patriotism arranged chronologically; an account book and composition book partially pasted over with human interest news-clippings; newsclippings on state, national, and international politics, 1912-1942; photographs of Atwood and unidentified men; programs; Republican campaign material; political pamphlets; and miscellaneous financial records.

The Volumes series consists of daybooks and ledgers of Atwood and of Atwood & Atwood, 1911-1924, and two volumes of programs and proceedings of the Republican National Convention of 1936 in which Atwood was a delegate from Missouri.
